§ 1 General
All mare owners who use our stallions, acknowledge the following conditions for all current and future business. The semen delivery can only be ordered if a copy of the proof of origin is present or the service certificate. Service certificate or copy of proof of origin shall be submitted strictly before the first insemination. Service certificates will be send back to the breeders by the relevant association after the full payment is received at the end of the breeding season. On top of the stud fee the payment for the shipment of semen is added. The payment should be made in cash or by check. The stud fee can also be transferred to the account below. The breeding season begins on 15th February and ends on 31 July.
§ 2 semen shipping
If a stallion is not available at short notice during the breeding season for special reasons (shows, illness, etc.) frozen semen can be used or another stallion in stud can replace. Refunding of the stud fee does not exist.
Semen production, delivery and shipping is done via the Holzeder stud.
Feel free to order your semen by phone or email from Monday to Friday from 8.00 to 17.00 h. Semen shipment is available on Saturday and Sunday, which is more costly. The cost of semen shipment is separately / directly calculated by the courier company and is put on top without further charge on the insemination bill.
You can pick up the semen at the stud Holzeder yourself if you want to.
In the semen order the following information must be given:
- Desired stallion
- Full name and address of the mare owner, breeding organization in which the insemination should be reported
- Accurate shipping address, details of the mare (name, life number, copy of the pedigree, age)
The semen shipping costs will be charged to the breeder. The cost of shipping outside Germany must be paid in advance.
Shipping costs within Germany: fresh semen 35,00 €
Shipping to Austria: fresh semen 45,00 €
The shipping containers and insemination reports are to be returned immediately to the stud. Every container which is not returned within two weeks (at FS containers a week) will be charged extra. The stud farm is not liable for improper insemination by the mare owner. Therefore only veterinarians, AI technicians or Stud owners should perform the insemination.
A refund of the stud fee does not exist. If a mare has not become pregnant after the second try, a recent sample shall be submitted. If the mare is still barren after the third insemination, an extra 50.00 € per insemination will be charged for the fourth and next inseminations.
§ 3 Bonus
For mares who did not get pregnant or absorbed, half the stud fee paid for the previous year shall be credited by providing a certificate before the 1 December signed by a veterinary. If there is no such certificate until that date, a deduction is not possible. Multiple mare discounts might be granted individually.
§ 4 Liability
The owner / owners of the mare assures that any risk is covered by a pet owners and animal keepers liability (§ 833 and § 834 BGB). He frees Vanessa Theresa Oppowa and commissioned third party from all claims for damages by third parties. The liability of the stallion stud for damage caused to the mare or her foal is excluded, unless the liability justifies evidence of intent and / or fraud and / or gross negligence of the stallion stud or of its authorized third party. Claims for damages are excluded. The parties agree that any claims of the mare owner shall expire within one year. Excluded from this limitation are any claims for damages which are based on at least gross negligence or at least negligent violation of life, body or health.
§ 5 german law
Should the mare or foal owners not have a German residence or place of business, nor is German national, the parties agree to the application of German substantive and procedural law for the implementation and execution of the contract. This also applies in the event of a legal dispute. If both parties are entrepreneurs, they agree on the seat of the stallion owner at Passau jurisdiction.
§ 6 Severability
Should any of the conditions be invalid, the rest retains its validity.
